The German version of these terms is the legally binding one. This English text is a courtesy translation; in case of any discrepancy, the German version prevails.

The short version. heybaum is a private, free project. You can use the map without an account. With an account you can add places, correct them, comment, and save places. What you contribute is public, and published contributions stay on the map even if you delete your account — but with your name removed.

1. Who runs this

heybaum.com is operated by Ansar Ahmad (address and contact in the Imprint). It is a private, voluntary, non-commercial project with no revenue, no advertising and nothing for sale.

These terms govern your use of heybaum.com. The Privacy Policy covers the handling of personal data.

2. Using the map without an account

The map, the species profiles and every place are available without registering. There is no guarantee of continuous availability: the service may be changed, limited or discontinued at any time.

3. Accounts

An account is optional and free.
Accounts are not intended for anyone under 16.
One account per person. Do not share your credentials.
You choose your display name; it is shown publicly beside your contributions. It must not infringe anyone's rights or impersonate another person or an authority.
You can delete your account yourself at any time (see section 7).

4. Your contributions

Contributions means places you add, edits to existing places, descriptions, ratings, notes, comments, reactions and reports.

You confirm that your contributions:

are your own and infringe nobody's rights — in particular contain no text copied from elsewhere;
are accurate to the best of your knowledge. If you mark a place as shady, child-friendly or quiet, somebody will walk there because of it;
contain no personal data about other people;
are not unlawful, abusive, threatening, discriminatory or harmful to minors;
contain no advertising, commercial offers or links to them;
do not concern places that are not publicly accessible, and do not direct people onto private property.

Everything you contribute is public — visible to people without an account too, alongside your display name. Do not write anything you would not want publicly readable.

5. Rights in your contributions

You keep the rights in what you write. So that heybaum can display it at all, you grant the operator a non-exclusive, worldwide, perpetual, royalty-free licence to store, reproduce, publicly display and technically adapt your contribution (for formatting or shortening) within heybaum.

Open data: heybaum publishes derived datasets for download which are derived from OpenStreetMap data and are therefore offered under the Open Database License (ODbL) 1.0 (see Data & licences). Factual details of a place — name, category, features and coordinates — may form part of those files, and by contributing you agree to their publication under ODbL 1.0. Free text, meaning your descriptions and comments, is excluded and is shown only on heybaum itself.

This licence continues for as long as a contribution remains published under section 7. Otherwise it ends when the contribution is deleted.

6. Moderation

Reported content is reviewed by a human. Nothing is hidden automatically and there is no automated decision-making within the meaning of Art. 22 GDPR.

The operator may remove or amend contributions that breach section 4, and may suspend or close accounts for repeated or serious breaches of these terms. For minor breaches you will be told first where that is reasonable. There is no right to have a contribution published.

Newly added places are reviewed before publication. Edits to already published places appear immediately and are recorded.

7. Deleting your account, and what remains

When you delete your account, the following are deleted:

your account, email address and display name;
your ratings, notes, comments, replies and reactions;
your reports;
your saved places;
any place you added that is still awaiting review.

What stays. Places you added that are already published, and your edits to other people's places, remain on the map. Other people have saved and commented on them by then, and a map that develops holes when one person leaves is unusable for everyone else. Your display name and user ID are replaced with "user deleted", so nothing links them to you. The licence in section 5 continues for those contributions.

8. No warranty for what the map shows

Tree records come from the City of Frankfurt's tree register and are not verified by heybaum. A tree may have been felled and still appear here.
Shade tiers are this project's own calculation, not an official figure.
Places and their features come partly from automatic analysis and partly from other users. They are estimates, not promises.
Check for yourself on site what applies to you — opening hours, rights of access, and the leash rules in force. The operator is not liable for breaches of local rules.

9. Liability

The operator is liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence, liability arises only from breach of a material obligation whose fulfilment makes proper use possible in the first place and on whose observance you may rely, and is limited to the foreseeable damage typical for this kind of agreement. Liability under the German Product Liability Act is unaffected.

For content originating from users, §§ 7 to 10 DDG apply.

10. Changes to these terms

These terms may change, for instance if the service or the legal position changes. Registered users will be told about material changes by email. If you do not object within six weeks, or continue to use your account after that, the amended terms are deemed accepted; otherwise you may delete your account.

11. Governing law

German law applies. Mandatory consumer protection rules of the country where you are habitually resident are unaffected. The operator is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If any provision of these terms is invalid, the remainder is unaffected.
